602 Forensic Monitoring Service

This policy identifies the procedures for coordinating services and monitoring individuals who have been found Not Guilty by Reason of Insanity or Incompetent to Stand Trial and, who are on conditional release in the community. These procedures are designed to facilitate access to treatment, while at the same time ensuring a higher degree of public safety by minimizing the likelihood of re-offending during release.
It is the policy of the Board that individuals found not guilty by reason of insanity or incompetent to stand trail, and who are in the community on conditional release, will have access to appropriate AoD and mental health treatment services. Standards for tracking and reporting on these individuals, as set forth in S. B. 285, and by the Ohio Department of Mental Health and the Tri-County Board, will be followed. The treatment status of individuals being monitored will be reported to the court of jurisdiction. Reports will be submitted monthly unless the terms of conditional release are violated. In cases where a violation has occurred, the court of jurisdiction will be immediately notified.
In addition to monitoring treatment activities, the Board will identify treatment providers and function as a liaison between the criminal justice system and appropriate treatment agencies. The Board will monitor the referral process to help ensure the accessibility of treatment services.
It is the responsibility of the Executive Director to oversee the forensic monitoring process and designate appropriate staff to fulfill the responsibilities of a forensic monitor.
