414 Workers’ Compensation

State law provides that all employees are covered by Workers' Compensation for injuries that arise out of or in the course of employment. Employees injured in the course of their employment may elect to use up to twelve (12) weeks of accrued sick leave prior to receiving Workers' Compensation payments, and thereafter have a proportionate amount of their sick leave reaccredited by directing all Workers' Compensation payments to the Tri-County Board.
All injuries which arise out of or in the course of employment shall be reported and compensated for under this Workers' Compensation section and not under the Board's health insurance plan.
Injury Reports. When an employee is injured during the course of employment, the Director of Finance and Administration shall provide the employee with an Employee's Report of Injury Form or other applicable County form. The form(s) shall be completed regardless of the apparent seriousness of the injury and whether or not medical attention is required. Such forms shall be completed by the employee and forwarded to the Director of Finance and Administration within twenty-four (24) hours of the injury. The Director of Finance and Administration shall review and complete the form(s) and forward same to the County's Personnel/Benefits Office. It is the employee’s duty to report all work-related injuries to the Director of Finance and Administration.
Application for Payment of Medical Benefits Only. When an employee's injury requires any type of medical attention, the Director of Finance and Administration shall, in addition to the Injury Report(s) described above, coordinate the completion of any additional required forms. These forms shall be completed and signed by the employee and given to the Director of Finance and Administration who shall forward them to the Personnel/Benefits Office. The Personnel/Benefits Office will handle any coordination required regarding the completion of forms by attending physician(s). Upon return of the forms from the attending physician, the Personnel/Benefits Office will forward a copy of the forms to any required parties.
Application for Payment of Compensation and Medical Benefits. When, in addition to medical attention, an employee's injury results in the employee's absence from work for seven (7) days or more, the employee may wish to complete an Application for Payment of Compensation and Medical Benefits. If the employee desires to submit this application, it should filled out and given to the Director of Finance and Administration for completion. The form will then be forwarded to the Personnel/Benefits Office, which will provide a copy to any required parties.
Serious Injury. In the event of an injury requiring immediate medical attention, the injured employee's supervisor shall notify the Director of Finance and Administration immediately so that an investigation can be initiated.
Return to Work. The Director of Finance and Administration must be advised and continually updated if an employee continues to be absent due to a work-related injury. Employees are responsible for providing their expected date of return (if known). The Director of Finance and Administration is responsible for immediately notifying, the Personnel/Benefits Office when an employee is able to return to work.
Documentation. Any documents received from the injured employee, the employee's physician, the hospital or the State regarding Workers' Compensation claims must be immediately forwarded to the Director of Finance and Administration and to the Personnel/Benefits Office.
Wages on Injury Date. Employees who are injured during the course of employment and who must leave work before completing their work period shall be paid at their regular rate for the balance of time left in their scheduled work day.
Repurchase of Used Sick Leave. An employee injured during the course of employment, and who makes application for Workers' Compensation payments, may elect to use accrued sick leave in accordance with Board policy prior to receiving payments from Workers' Compensation. Employees shall sign an Agreement directing all Workers' Compensation payments to the Board as reimbursement for such payment and shall have a proportionate amount of their sick leave reaccredited upon receipt of the Workers' Compensation payments by the Board. Payment of sick leave in this manner shall not exceed twelve (12) weeks for each injury authorized for payment by the Bureau of Workers' Compensation.
Simultaneous Payments. Employees are prohibited from receiving payment for sick leave (but may receive other paid leave) while simultaneously receiving payment from Workers' Compensation.
Accommodation of Disabled Employee. When confronted with an employee claiming a disability under the Workers' Compensation system, who is disabled as defined in the Americans with Disabilities Act, the Board will consider making a reasonable accommodation that would allow the employee to continue performing the essential functions of the employee's position. When submitting information to the Bureau of Workers' Compensation or the Industrial Commission, the Board will include:
a. copies of the employee's position description and essential duties list;
b. related medical records; and
c. any offer of reasonable accommodation.
The Board will provide the same information to any examining physician or other appropriate, licensed practitioner.
