409 Leave of Absence Without Pay

Eligibility. Any employee may request a leave of absence from employment without pay. Approval of such request is solely at the discretion of the Executive Director, and each request will be determined on its own merits. The Executive Director shall approve leave under this policy for circumstances covered by the Family and Medical Leave Act.
Return From Leave. Upon returning from an approved leave of absence, the employee shall be placed in the employee's original position, or another position in the same classification according to applicable state and federal laws.
Failure to Return. Failure to return to work within three (3) days after the scheduled end of an authorized leave of absence without acceptable justification will be deemed a voluntary resignation effective as of the scheduled expiration of the authorized leave.
Effect on Employment. Sick and vacation leave are not earned by employees while on leave(s) of absence without pay. A leave of absence without pay shall not be considered a break in service.
No employee shall have secondary employment while the employee is on leave of absence.
Benefits. Employees on a Leave of Absence Without Pay will be required to maintain any premiums for their voluntary insurance benefits. Employees should contact Miami County Human Resources to coordinate payment plans for these policies to remain in effect.
