409 Leave of Absence Without Pay

Eligibility. Any employee may request a leave of absence from employment without pay. Approval of such request is solely at the discretion of the Executive Director, and each request will be determined on its own merits. A leave of absence without pay shall not exceed six (6) months. The Executive Director shall approve up to twelve (12) weeks of leave under this policy for circumstances covered by the Family and Medical Leave Act.
Return From Leave. Upon returning from an approved leave of absence, the employee shall be placed in the employee's original position, or another position in the same classification should the employee's original position be unavailable.
Failure to Return. Failure to return to work within three (3) days after the scheduled end of an authorized leave of absence without acceptable justification will be deemed a voluntary resignation effective as of the scheduled expiration of the authorized leave.
Effect on Employment. Sick and vacation leave are not earned by employees while on an authorized leave of absence without pay. A leave of absence without pay shall not be considered a break in service.
Requests. All requests for leaves of absence without pay shall be submitted to the supervisor on a Request For Leave of Absence Form, indicating the specific reason for the requested leave and with all supporting documentation attached.
