403 Sick Leave

Original Approval Date: April 19, 1995

Accrual.  Employees earn .0575 hours of sick leave for each hour in active pay status (except overtime hours worked) up to a maximum 4.6 hours per two-week pay period for full time employees.  Employees may accrue and carry over all sick leave earned with no limits.
 
Credit For Prior Service.  Employees who previously separated from the Tri-County Board or from the State or a county, municipality, Board of Education, library, township or other political subdivision, will be credited with their unused balance of accumulated sick leave if the time between separation does not exceed ten (10) years and the unused balance has not been converted to cash.  Employees are responsible for informing the Board of such prior service.
 
Usage.  Sick leave may be used for the following reasons:
 
          a.         Illness or injury or pregnancy or childbirth related conditions of the employee, or of a member of the employee's immediate family where the employee's presence is reasonably necessary; 
 
          b.         Exposure of employee or a member of the employee's immediate family to a contagious disease which would have the potential of jeopardizing the health of the employee or the health of others;
 
          c.         Death of a member of the employee's immediate family,
 
          d.         Medical, dental or optical examinations or treatment of employee, or of a member of the employee's immediate family when the employee's attendance is reasonably necessary and when such examination or treatment cannot be scheduled during non-work hours.
 
Immediate Family.  For purposes of this policy, "immediate family" is defined as the employee's:  mother, father, brother, sister, child, step-child, spouse, grandparent, grandchild, mother-in-law, father-in-law, sister-in-law, brother-in-law, daughter-in-law, son-in-law, legal guardian or other person who stands in the place of a parent.
 
Payment.  Employees absent on approved sick leave shall be paid at their applicable hourly or salaried rate.  If requested sick leave is denied and as a result an employee is overpaid, such over-payment shall be deducted from the employee's next paycheck.  Sick leave shall be charged in 1/4-hour increments.
 
Denial.  The Board maintains the right to investigate the circumstances surrounding an employee's request for sick leave.  A request for sick leave shall be denied if:
 
            a.         The employee fails to comply with the procedure for proper sick leave usage.
 
            b.         The employee fails to present a required medical practitioner's statement or a properly completed request form.
 
            c.         Investigation of a request discloses facts inconsistent with the proper use of sick leave.
 
Use of Vacation Leave.  Employees without accrued sick leave who are absent for a reason qualifying for use of sick leave hereunder may use accrued vacation leave for such absence.  The granting of such leave shall be at the discretion of the Executive Director.
 
Funeral Leave.  All employees may, upon approval of their supervisor, use up to a maximum five (5) consecutive days of accrued sick leave in the event of the death of an immediate family member.
 
Sick Leave Conversion.  Payment of accrued but unused sick leave will be made to each employee upon service retirement under OPERS/STRS from active service with the Board and with at least ten (10) years of service as a public employee.  Such payment shall be made only once to any employee, and the amount of such payment shall be one-fourth (1/4) of the employee's accrued but unused sick leave, up to a maximum payment for thirty (30) days or current OPERS policy. Employees who are exercising the retire/rehire option through OPERS/STRS shall not be deemed to be separating from employment for purposes of this policy if the retire/rehire dates are considered consecutive.  Once such payout is made, the employee sick leave balance shall start at zero hours and employee shall begin to accrue again for use during their reemployment period at the current stated rate.
 
Payment shall be based on the employee’s rate of pay at the time of retirement.  Payment under this policy shall be considered to eliminate all sick leave credit accrued by the employee at the time of payment.
 
Beneficiaries of a deceased employee shall be eligible for the sick leave conversion benefits for which the employee would have otherwise qualified hereunder.  Such payment shall be made in compliance with ORC Section 2113.04.
 
Procedure
An employee requesting sick leave for a scheduled medical appointment shall notify the supervisor as soon as possible.  An employee requesting sick leave for other than a scheduled appointment must notify the supervisor of the employee's absence and reason therefore no later than 1 (one) hour after the employee's scheduled starting time.  The employee should call in each and every day the employee will be absent, unless otherwise instructed by the supervisor.
 
Upon return to work from sick leave, an employee must complete a Request For Leave of Absence, and return same to their supervisor within three (3) working days.
 
If an illness or injury extends for three (3) or more consecutive work days, or in cases of a pattern of sick leave usage, the supervisor may require a medical practitioner's statement stating the date and nature of the illness or injury and that the employee is able to return to work and perform the duties of their position.
 
The supervisor shall review the completed Request For Leave of Absence and the circumstances surrounding the absence and approve or deny the sick leave by appropriate signature on the Request For Leave of Absence.
 
The supervisor shall inform any employee whose sick leave request is denied of the reasons for the denial, and thereafter take all necessary disciplinary action.
 
An employee without accrued sick leave who is absent for a reason qualifying for use of sick leave hereunder shall, upon return to work from such absence, request use of vacation leave from his/her supervisor.  The granting of such vacation leave shall be contingent on the employee having an adequate vacation balance, and shall be at the discretion of the supervisor.
 
An employee requesting Funeral Leave must complete a Request For Leave of Absence Form.  A copy of the family member's obituary, or other proof of death should be provided if requested by the supervisor.
