410 Disability Leave

Original Approval Date: April 19, 1995
Revision Effective: May 20, 2009
Supersedes:

A disabled employee who requests a "reasonable accommodation" (See Policy 203) which the Tri-County Board is not required to or cannot accommodate and who has exhausted his/her sick leave, may request an unpaid leave of absence.

All questions or inquiries concerning reasonable accommodation and unpaid leave should be directed to the Director of Finance and Administration.

Disability Leave of Absence.  A disabled employee, who does not qualify for an accommodation and who has exhausted accumulated sick leave, may request and may be granted a leave of absence without pay.  Unpaid disability leaves are normally for the period of the disability, up to a maximum of 12 weeks within a 12 month period. The 12 week maximum applies to any combination of both medical leave and family leave during any 12 month period. The employee must present written evidence from a licensed physician of a probable date of return to the same position.  Such requests shall be in writing, with supporting evidence attached prior to such leave being granted.

An employee requesting or receiving approval for a disability leave of absence due to a disabling illness, injury or condition is subject to the provisions of the Leave of Absence Without Pay policy (#409) in this manual.
